Overview:

Kildare County Council provides a network of Bring Banks / Centres throughout the county for use by members of the public to recycle glass. One such facility is located in Edmund Rice Square, Athy, Co. Kildare which is accessible 24 hours a day.

The setting is a pay parking area adjacent to several retail units which is regularly used by the local community and is adjacent to the river Barrow, a special area of conservation.

Despite “No Dumping” signage being in place, illegal dumping has become more frequent at this location. Various items are being dumped, not only bags/boxes used to bring bottles to the recycling banks.

The scale of illegal dumping at this site can potentially cause harm to wildlife along the river as well as resulting in unsightly scenes for the local community. It is also impeding access to the bring banks for people who want to recycle responsibly.

 

The Circular Economy & Miscellaneous Provisions Act 2022 provides for use of CCTV by a Local Authority for the purposes of prevention, detection and prosecution of litter offences.

There are separate codes of practice for the use of CCTV for waste/litter purposes:

  • Code of Practice for the Operation of CCTV for the Purposes of Prevention, Detection, & Prosecution of Waste Offences.
  • Code of Practice for the Operation of CCTV for the Purposes of Prevention, Detection, & Prosecution of Litter Offences.

Under this legislation, CCTV cameras can be deployed at locations where there is a history of illegal dumping and where other initiatives to prevent it have failed.

 

What we are proposing:

Kildare County Council is proposing to erect three CCTV cameras one facing each way towards the bring banks in Edmund Rice Square, Athy. This initiative aims to address the ongoing issue of illegal dumping at the Bring Bank Centre located within the square.

The purpose of CCTV deployment is to prevent the area being used for fly-tipping and to capture registration plate numbers of vehicles where it is evident from CCTV coverage that the vehicle owners have been responsible for illegal dumping.

Signage will be affixed at the bring banks to inform the local community of the presence of CCTV.  The cameras will be in situ for an initial period of three months.

 

 

Consultation:

Under the codes of practice, before the introduction of CCTV, a rigorous procedure is to be followed to ensure that the deployment of CCTV cameras is necessary, targeted and proportionate. Conducting a public consultation is part of this process.

This online public consultation relates only to use of CCTV at the Bring Bank / Centre located at Edmund Rice Square, Athy.
