Meadowbrook Estate- Proposed Works

Under Section 180 of the Planning and Development Act 2000 (as amended) and Section 11 of the Roads Act 1993, Kildare County Council have initiated the taking in charge process of the Meadowbrook estate, Maynooth including: Meadowbrook Lawns, Meadowbrook Close, Meadowbrook Avenue, Meadowbrook Drive, Meadowbrook Court, Meadowbrook Crescent.

In accordance with the Kildare County Council Taking in Charge Policy 2008 the following services and public areas associated with a development, where they are deemed to be providing a ‘general public utility’ are taken in charge by the Local Authority:

  • Roads (including distributor and estate roads) and their ancillary footpaths, trees, margins, street furniture, underground ducting and generally the area between opposite boundaries.
  • Unallocated surface parking areas provided no gate or barrier has been erected.
  • Public lighting.
  • Public open spaces: spaces to which the general public have access, but taking in charge does not include grass cutting, or maintenance of grass verges, incidental ornamental/landscaped areas, shrubberies, or playgrounds unless such playgrounds are required as a facility which will be available to the general public by way of a planning permission condition.
  • SuDS features above ground such as ponds, swales and detention basins where these SuDS features are located in public areas. (Note: Grass cutting is the responsibility of the residents of the estate.)
  • Surface water infrastructure below ground comprising of assets such as pipes, manholes, attenuation systems, pump stations etc.

**Foul water infrastructure and the watermain are the responsibility of Úisce Eireann.  Úisce Eireann infrastructure will be taken in charge as part of the taking in charge process.

A site resolution plan (SRP), to bring infrastructure in the estate to a ‘general public utility’ standard, has been prepared.  Priority works include footpath and public lighting repairs.  These works are required in the interest of public safety and involve:

  1. The removal of certain trees, which are causing damage to footpaths, from the grass verge; and
  2. The excavation and reconstruction of sections of footpath.

These works will be undertaken on a phased basis with tree removal occurring first followed by footpath excavation and reconstruction occurring in priority areas.

At certain locations in Meadowbrook the property boundary walls have been constructed on the footpath.  At these locations, where works to the public footpath are necessary, demolition of the boundary wall may be required.  Affected property owners will be contacted directly.

The first step in the process is the tree removal programme. Particulars of the tree removal and replanting proposals are attached to this Consultation.

Observations should be made via the consultation portal, or emailed to devcontrol@kildarecoco.ie , or posted to the Administrative Officer, Development Control Section, Kildare County Council, Level 4, Áras Chill Dara, Devoy Park, Naas, Co. Kildare and marked with the ref. no DC1203 and Meadowbrook, Maynooth.

Observations should be made in writing before 17:00 on Friday the 27th of October.
